Thomas Durbin Will - 1810

Will Book RB-1, p. 90.

Executor Honour and Daniel Durbin. Frederick County to wit on the 23rd day of April 1810 then came Honour Durbin and Dan Durbin and made oath on the holy evangelists of Almighty God that the foregoing Instrument of writing is the true whole will and Testament of Thomas Durbin late of Frederick County Deceased that hath come to their hands and professed and that they do not know of any other.

Frederick County to wit on the 23rd day of April 1810 then came Daniel Hefnon and John Jones two of the subscribing witnesses to the foregoing last will and Testament of Thomas Durbin late of Frederick County Deceased and made Oath on the holy Evangelists of Almighty God that they did see the Testator therein named sign and seal this will, that they heard him publish pronounce and declare the same to be his last will and Testament that at the time of his so doing he was to the best of their apprehensions of a sound and disposing mind memory and understanding that they respectively subscribed their names as witnesses to this will in the presence and at the request of the Testator. And that they did also see Peter Hefson the other subscribing witness sign his name as a witness to said will in the presence and at the request of the Testator and all in the presence of each other.

In the Name of God Amen, I Thomas Durbin of Frederick County State of Maryland being sick and weak in body but of sound and disposing mind memory and understanding thanks be given to God and calling to mind the mortality of my Body and knowing it is appointed for all men once to die do make and ordain this my last will and Testament that is to say principally and first of all I give and recommend my soul unto the hands of God that give it and for my body I recommend to the earth to be decently buried in a Christian like and Decent manner at the direction of my Executor hereafter named nothing doubting but at the general resurrection I shall receive the same again by the mighty power of God and as touching such worldly estate it hath pleased God to help me with in this life and give devise and dispose of the same in the following manner and form. It is my will and do ordain that in the first place all my just debts and funeral charges be paid and satisfied.

Item It is my will and I do hereby order that that piece of Land I have ... which lies on one side of Gravelly Ridge adjoining Land of Peter Mack, Peter Erb and others which contains forty three acres more or less to be sold for the best Price can be got by my Executor hereinafter named as soon as convenient after my decease and I do hereby authorize and empower by said Executor to make over and convey the same to the purchaser in fee and as fully as I could have done where I personally present and the money arising such sale to be given to my son Nicholas Durbin or his heirs.

Item I give and bequeath to my beloved daughter Mary the sum of four hundred Dollars to be paid to her as it become due from Perter Mack.

Item I give and bequeath to my beloved daughter Ann the sum of four hundred Dollars to be paid to her as it become due from Peter Mack.

Item I give and bequeath to my beloved Grand Daughter Honour Logan the sum of two hundred Dollars to be paid to her out of my estate.

Item I give and bequeath to my Dearly beloved wife Honour all the remainder of my land which is unsold together with all buildings privileges benefits advantages thereunto belonging to be by her peaceably enjoyed during her natural life - also all my stock and personal estate that is remaining and my will and desire is after the death of beloved wife, the land and Personal Estate that is left to be sold and conveyed as above by my Executor and the money arriving from such sale to be Divided as follows. Two hundred pounds current money shall be given to my daughter Margaret and the remainder to be Equally Divided among my three Daughters namely, Margaret, Mary and Ann or to the heirs of their bodies.

And whereas my sons Philip Durbin and Thomas B. Durbin hath already received a full share of my Estate in my life time, I give and bequeath to each of my said Sons the further sum of one Dollar to be paid to them out of my Estate and no more.

And whereas my son Dann Durbin, I have already conveyed part of my land which I deem and it is also my will that shall be his full share of my Estate's .. and personal and no more.

And Lastly I do hereby constitute and ordain my beloved wife Honour and my son Dan Durbin my sole Executors of this my last will and Testament and I do hereby utterly disallow revoke and ... all and every other former wills and Testaments and Executors by me heretofore named ratifying and confirming this and no other to be my last will and testament. In witness whereof I have hereunto set my hand and fixed my seal this day and year first above written.

Signed and published pronounced and declared by the said Testators as his last will and Testament in the presence of ... subscribers. Daniel Goodson, Zacharia Gibbon and John Jones. Signed and Sealed Thomas Logsdon.
